Short on the heels of this addition you will also receive the July and August updates. Everyone with interests in the mining and petroleum sectors are surely abuzz with the implications of the recent amendments to the Mineral and Petroleum Resources Development Act (MPRDA) as well as the concomitant amendments to the National Environmental Management Act (NEMA). MacRobert recently hosted a workshop on legal developments in the Mining sector, touching on some of these issues. Given the feedback received, the workshop was very successful (We also had great feedback on the catering!). We have since received requests that this workshop be re-run in the near future. If you are interested in attending such a workshop, please let us know so that we may provide you with a preferential invitation. Given these amendments, (which include some rather startling errors) it comes as no surprise that the National Environmental Management: Waste Act (NEMWA) is also earmarked for changes to incorporate the management of mining related wastes. More specifically, it is proposed that Residue Stockpiles and Deposits as defined in the MPRDA will be regulated in terms of the NEMWA, albeit under the auspices of the Department of Mineral Resources. The burning question now, is how the recently published regulations on waste classification and disposal requirements in terms of the NEMWA may affect the mining sector, given that these would now find application in respect of residue stockpiles and deposits.
