EnviroMac Newsletter: ISSUE 9 / january 2014 Dear clients and subscribers Each EnviroMac newsletter reflects the legislative developments of the preceding calendar month. As such, we do not include in this issue the two important notices issued by the Minister of Mineral Resources relating to the restriction of applications for- and granting of various rights in respect of petroleum, including oil and gas during February. However, the newsflashes were circulated on 5 February 2014. This then also illustrates the essential function of the newsflashes, that being to immediately disseminate important information that should not wait for the monthly EnviroMac. All newsflashes will shortly also be available on our new website. Although not strictly related to environmental issues as such, we would be remiss if reference is not made to the Promotion and Protection of Investment Bill. If enacted, the Bill may affect both local and foreign investors in any number of ways, including the controversial termination of existing Bilateral Investment Treaties. We wish however to draw your attention specifically to the provisions of section 8. These provisions will, if passed, provide for deprivation of certain property rights by the state without market value compensation or without compensation at all, under varying circumstances.
