The President has assented to the National Water Amendment Act 27 of 2014 ("Amendment Act"), which amends the National Water Act 36 of 1998 ("NWA"). The Amendment Act provides for, amongst other issues, the alignment and integration of the process for a water use licence with the timeframes and processes applicable to mineral rights in terms of the Mineral and Petroleum Resources Development Act 28 of 2002 and environmental authorisations in terms of the National Environmental Management Act 107 of 1998. The Amendment Act furthermore enables an applicant (and only an applicant) for a water use licence involving an integrated process as referred to above, to appeal against a decision made by a responsible authority to the Minister of Water and Sanitation.
