DRAFT NATIONAL ATMOSPHERIC EMISSION REPORTING REGULATIONS

The Minister of Environmental Affairs has given notice of her intention to make regulations regarding national atmospheric emission reporting under sections 12(b) and (c) and 53(aA), (o) and (p) read with section 57 of the National Environmental Management: Air Quality Act 39 of 2004 ("NEMAQA").

The regulations will impose reporting and record keeping obligations on persons which classify as data providers. The following persons need to register as data providers on the National Atmospheric Emission Inventory System –

  • Any person undertaking an activity listed in terms of section 21(1) of the NEMAQA (Group A);
  • Any person who uses an appliance or conducts an activity which has been declared a controlled emitter in terms of section 23(1) of the NEMAQA (Group B);
  • Mines (Group C); and
  • Any person that operates a facility with criteria pollutants who are not listed in Group A and B (Group D).

Members of the public are invited to submit written representations on the regulations to the Minister within 30 days of publication of this notice (i.e. on or before 18 August 2014).
