The Minister of Water and Environmental Affairs, has amended the list of activities which result in atmospheric emissions which have or may have a significant detrimental effect on the environment, including health, social conditions, economic conditions, ecological conditions or cultural heritage ("GNR 839").

The effect of GNR 839 is that the listed activities promulgated in terms of the National Environmental Management: Air Quality Act 39 of 2004 ("NEMAQA") under GNR 248 on 31 March 2010 are repealed and replaced by GNR 839.

GNR 839 has included, inter alia, additional activities which require an atmospheric emission licence in terms of the NEMQA such as –

  • Subcategory 1.6: Waste Co-Feeding Combustion Installations;
  • Subcategory 2.2: Catalytic Cracking Units;
  • Subcategory 2.3 Sulphur Recovery Units;
  • Subcategory 3.6 Synthetic Gas Production and Cleanup;
  • Subcategory 5.2 Production of Caustic Powder; and
  • Subcategory 8.4 Drum Recycling Processes.

Further take note that there are also amendments to the special arrangements and the minimum emission standards for certain activities.
