The Minister of Environmental Affairs has made regulations, in terms of sections 97(1)(e), (f), (g), and (h) of the NEM:BA, in respect of bio-prospecting, access and benefit sharing.
The aforesaid regulations provide, inter alia, for the notification process for the discovery phase of bio-prospecting; the permit system for bio-prospecting; the form and content of, and requirements and criteria for benefit-sharing and material transfer agreements; and the administration process pertaining to the Bio-prospecting Trust Fund.
