NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT (39/2004): DECLARATION OF SMALL-SCALE CHAR AND SMALL-SCALE CHARCOAL PLANTS AS CONTROLLED EMITTERS

The Minister of Environmental Affairs has published her intention to declare small-scale char plants and small-scale charcoal plants as controlled emitters in terms of section 23(1) read with section 24 of the NEMAQA.

The Notice differentiates between 'new plants' (i.e. any plant or process where an application for authorisation in terms of the NEMA was made on or after 1 April 2010) and 'existing plants' (i.e. any plant or process which was legally authorised to operate before 1 April 2010 or where an application for authorisation in terms of the NEMA was made before 1 April 2010) and makes provision for different compliance timeframes pertaining to the emission limits as set out in this notice for new and existing plants respectively.

Members of the public were invited to submit written representations within 30 days from publication of this notice.
