The President has assented to the National Environmental Management Laws Second Amendment Act 30 of 2013 which makes various amendments to the National Environmental Management Act 107 of 1998, including amendments to, inter alia, section 24G of the Act and increasing the fine payable in respect of an offence from R5 million to R10 million.
The majority of the sections of the Amendment Act commence as from 18 December 2013. However, some sections, pertaining to, inter alia, emergency situations and environmental outlook reports, come into effect on 18 December 2014 or on a date fixed by the President by notice in the Government Gazette, whichever is the earlier.
