The President has assented to the National Water Amendment Act 27 of 2014, which amends the NWA with effect from 2 September 2014. The Amendment Act provides for, amongst other issues, the alignment and integration of the process for a water use licence with the timeframes and processes applicable to mineral rights in terms of the MPRDA and environmental authorisations in terms of the NEMA.
The Amendment Act furthermore enables an applicant (and only an applicant) for a water use licence involving an integrated process as referred to above, to appeal against a decision made by a responsible authority to the Minister of Water and Sanitation.
