MacRobert's Employment Law practice group represents, among others, employees and employers which include persons or businesses, state-owned enterprises, trade unions, local government institutions, major domestic and international corporations, bargaining councils and employers' organisations in all areas of business and industry.
Our areas of expertise include, among others, advising clients in employment dispute resolution and litigation; restructuring and retrenchments; disciplinary investigations and enquiries; unfair dismissals; unfair discrimination; strikes/lockouts; employment equity; labour broking services; non-payment of wages, overtime, leave and severance pay and the use of contracts in employment law (fixed-term employees and independent contractors). We can also assist with any Covid-19 related enquiries or processes.
We draft a wide range of employment-related agreements, policies, procedures and restraint of trade; and provide legal advice on all existing and new employment-related legislation.
In addition to providing legal advice to clients on employment-related issues, we represent and support clients by appearing in disputes and litigation matters and the review of CCMA/ bargaining councils’ arbitration awards. The forums in which we appear on behalf of clients include, but are not limited to, the CCMA, respective Bargaining Councils, the Labour Court and Labour Appeal Court.
We also offer services of chairing disciplinary hearings and offer training sessions for managers, shop stewards, IR consultants and human resources officers in relation to all areas of employment law.
