The Swartland Municipality has, under section 156 of the Constitution of the Republic of South Africa 1996, enacted the Air Quality By-Law as set out in this notice.
The by-law regulates air pollution within the area of the municipality's jurisdiction by, inter alia, establishing a duty of care which applies to all persons who are responsible for air pollution; setting certain emission standards and regulating the appointment of Air Quality Officers and Environmental Management Inspectors.
