NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT (59/2008): AMENDMENT TO THE LIST OF WASTE MANAGEMENT ACTIVITIES THAT HAVE, OR ARE LIKELY TO HAVE A DETRIMENTAL EFFECT ON THE ENVIRONMENT

The Minister of Environmental Affairs has given notice of her intention to amend the list of waste management activities that have, or are likely to have a detrimental effect on the environment, as published in terms of the NEMWA under GNR 921 of 29 November 2013 and amended by GNR 332 of 2 May 2014.

The proposed amendment introduces, as a waste management activity which requires a waste management licence, "prospecting, mining, exploration or production operation, resulting in development of residue stockpiles and residue deposits". The proposed amendment also introduces a provision apparently aimed at the application of the definition of waste in the mining context. This may cause interpretational problems in view of the fact that the list of waste management activities represent sub-ordinate legislation and that different wording to that of the Act is introduced.

Members of the public were invited to submit written comments within 30 days of publication of this notice.
