NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT (39/2004): PRIORITY AIR POLLUTANTS AND POLLUTION PREVENTION PLAN REGULATIONS

The Minister of Environmental Affairs has, in terms of section 29(1) read with section 29(4) of the NEM:AQA, published a schedule declaring the listed greenhouse gases as priority air pollutants and requires those persons falling into the category specified in the schedule to prepare and submit a pollution prevention plan in respect of such substances to the Minister for approval.

Furthermore, the Minister has, in terms of sections 53(a), (o) and (p) read with section 29(3) of the NEM:AQA, published regulations in respect of the preparation of pollution prevention plans in terms of section 29(3) of the Act. The requirement to prepare a pollution prevention plan is in respect of the greenhouse gases declared as priority pollutants in terms of section 29(1) of the Act, as set out above.
