The Minister of Water and Environmental Affairs, hereby makes regulations regarding air dispersion modelling, in terms of section 53(f) of the NEMAQA, as set out in the Schedule to this notice.
"Air dispersion modelling" is defined in the regulations as:"a series of mathematical simulations of how air pollutants disperse in the ambient atmosphere and is performed with computer programs that solve the mathematical equations and algorithms which simulate the dispersion of pollutants".
The Code of Practice, contained in Appendix A of the regulations, is prescribed as the technical Code of Practice for air dispersion modelling and is applicable –
(a) in the development of a specialist air quality impact assessment study, as contemplated in Section 37 (2) (b) of the Act.
(b) in the development of a priority area air quality management plan, as contemplated in Section 19 of the Act;
(c) in the development of an atmospheric impact report, as contemplated in Section 30 of the Act;
(d) in the development of a specialist air quality impact assessment study, as contemplated in Section 37 (2) (b) of the Act.
A relevant authority must refuse to accept air dispersion modelling results, if any person or organ of state fails to comply with the Code of Practice for air dispersion modelling.
